In order to standardize the contractual behavior of market entities, promote fairness in the construction market, and maintain the order of the construction market, the Department of Construction Market Regulation of the Ministry of Housing and Urban-Rural Development has recently revised the Model Text of the Construction Contract, the Model Text of the Construction Professional Subcontract, and the Model Text of the Construction Labor Subcontract, and has solicited public comments from society.

The Model Text of the Construction Contract sets out the following clauses regarding “the application of Building Information Modeling (BIM) technology”:

Where Building Information Modeling technology is adopted, the contract parties shall comply with the provisions of the current relevant national standards and conform to the relevant local standards or guidelines of the place where the project is located. The contract parties shall, in the specific contract conditions, agree on the development, use, storage, transmission, and delivery of the building information model, the ownership of intellectual property rights, and the related fees, among other matters. Unless otherwise agreed in the specific contract conditions, the contractor shall be responsible for negotiating with the other users of the model in this project.

In order to standardize the contractual behavior of market entities, promote fairness in the construction market, and maintain the order of the construction market, and in light of current realities, we have organized the revision of the Model Text of the Construction Contract (GF-2017-0201), the Model Text of the Construction Professional Subcontract (GF-2003-0213), and the Model Text of the Construction Labor Subcontract (GF-2003-0214), forming three model contract texts (draft for comments) (see the attachment for details), and now solicit public comments from society. Relevant organizations and individuals may submit their feedback through the following channels and methods before July 30, 2025.
